An EU obligation, not a national one
Article 11 of the recast Energy Efficiency Directive (EU) 2023/1791 replaced company size with a single criterion: average annual energy consumption over the previous three years, taking all energy carriers together.
- Above 85 TJ (23,611 MWh, or 23.6 GWh): an energy management system is mandatory and must be certified by an independent body against the relevant European or international standard. In practice that means ISO 50001; some member states also accept EMAS. The directive sets the deadline at 11 October 2027.
- Above 10 TJ (2,778 MWh) without an energy management system: an energy audit is required, the first one by 11 October 2026, and at least every four years thereafter. A certified ISO 50001 system removes that obligation — which is why organisations in this band, especially those with several sites, often choose certification instead of repeating audits indefinitely.
Everything counts towards the threshold: electricity, natural gas, purchased heat and steam, fuel for vehicles and processes, and self-generated electricity consumed on site. Consumption is summed across the whole enterprise, not per site.
Two things matter for groups. First, member states may set stricter rules than the directive — several have lower thresholds or tighter deadlines, so a site that falls outside the obligation in one country can fall inside it in another. Second, the deadline is national. The directive sets 11 October 2027 as the outer limit, but transposing laws differ, and a certificate held by the parent company does not automatically cover a subsidiary that is itself in scope.
The Czech Republic: the transposition this webinar covers
Czechia transposed the directive through Act No. 87/2025 Coll., amending Act No. 406/2000 Coll. on energy management, in force since 1 January 2026. It follows the EU thresholds and adds national specifics:
- Deadline: two years from the date the obligation arises, so 31 December 2027 for organisations already above the threshold on 1 January 2026. This is the date Czech entities work to; the directive's 11 October 2027 is the EU-level requirement on the member state.
- Certification must be carried out by a body accredited by the Czech Accreditation Institute (ČIA).
- Groups: entities with an ownership share above 50 % are added into the calculation.
- Penalty: up to CZK 5 million (approximately EUR 200,000).
- Public sector has separate, lower audit thresholds.
Implementation takes 9 to 18 months and accredited bodies book certification audits months ahead, which is the real constraint behind the deadline.
